User Data is personal data collected directly from you or from our customer organization on behalf of which you are using the Kasapp Services (“Customer Organization”), as the case may be. We may collect User Data from our Users and Customer Organizations in a variety of ways, including, after conclusion of a service agreement with the Customer Organization or when Users register to the Kasapp Services, subscribe to a newsletter or fill out a form. Your user or customer experience may be enhanced by providing us with the following information: Additional Account Information: a picture delivery address location data (if you consent to the processing of your location data) other information you provide either when creating a user account or later when modifying your account profile Other Information. The Kasapp Services use pseudonymized identifiers to track and predict your app and service usage and preferences. There are several purposes of the processing of your personal data by Kasapp: To provide the Kasapp Services and carry out our contractual obligations (legal ground: performance of a contract and legitimate interest) Kasapp processes your personal data to be able to offer the Kasapp Services to you under the contract between you and Kasapp or between Customer Organization and Kasapp. We use the data for example to handle your payments or any refunds (where applicable) and to provide our partners (the merchants and our couriers) with the information necessary for the preparation or delivery of your order. If you contact our customer service, we will use the information provided by you to answer your questions or solve your complaint. For our legal obligations (legal ground: compliance with a legal obligation) Kasapp processes data to enable us to administer and fulfil our obligations under law. For claims handling and legal processes (legal ground: legitimate interest) Kasapp may process personal data in relation to claims handling, debt collection and legal processes. Kasapp stores your personal data primarily within Finland . However, we have service providers and operations in several geographical locations. As such, we and our service providers may transfer your personal data to, or access it in, jurisdictions outside Finland or the User’s domicile. We will take steps to ensure that the Users’ personal data receives an adequate level of protection in the jurisdictions in which they are processed. To the extent that third parties (such as the merchants which prepare your order, our courier partners who deliver your order and Customer Organization which may pay your order) need access to personal data in order for us to perform the Kasapp Services, we provide such third parties with your data. Furthermore, we may provide your personal data to our affiliates or to authorized service providers who perform services for us (including data storage, accounting, sales and marketing) to process it for us and to payment service providers to process your payments to us.
When data is processed by third parties on behalf of Kasapp, Kasapp has taken the appropriate contractual and organizational measures to ensure that your data are processed exclusively for the purposes specified in this Privacy Statement and in accordance with all applicable laws and regulations and subject to our instructions and appropriate obligations of confidentiality and security measures.

If Kasapp is involved in a merger, acquisition or asset sale, we may transfer your personal data to the third party involved. However, we will continue to ensure the confidentiality of all personal data. We will give notice to all the Users concerned when the personal data are transferred or become subject to a different privacy statement.
With your explicit consent
We may share your personal data with third parties outside Kasapp when we have your explicit consent to do so. You have the right to withdraw this consent at all times free of charge by contacting us support@Kasapp.world.
Kasapp does not store your personal data longer than is legally permitted and necessary for the purposes of providing the Kasapp Services or the relevant parts thereof. The storage period depends on the nature of the information and on the purposes of processing. The maximum period may therefore vary per use. Most personal data relating to a User’s user account with the Kasapp Services will be deleted after a period of 90 days have lapsed after the User has deleted its user account with the Kasapp Services. Thereafter, a part of the personal data relating to a User’s user account with the Kasapp Services may be stored only as long as such processing is required by law or is reasonably necessary for our legal obligations or legitimate interests such as claims handling, bookkeeping, internal reporting and reconciliation purposes. All personal data relating to a User’s user account with the Kasapp Services will be deleted within a period of 10 years after the User has deleted its user account with the Kasapp Services, with the exception of personal data required in certain rare situations such as legal proceedings. We will store Analytics Data of Users that do not have an account with the Kasapp Services for a period of 90 days.
Right of access
You have the right to access and be informed about your personal data processed by us. We give you the possibility to view certain data through your user account with the Kasapp Services or request a copy of your personal data.
Right to withdraw consent
In case the processing is based on a consent granted by the User, the User may withdraw the consent at any time free of charge. Withdrawing a consent may lead to fewer possibilities to use the Kasapp Services. The withdrawal of consent does not affect the lawfulness of processing based on consent before its withdrawal.
Right to rectify
You have the right to have incorrect or incomplete personal data we have stored about you corrected or completed by contacting us. You can correct or update some of your personal data through your user account in the Kasapp Services.
Right to erasure
You may also ask us to delete your personal data from our systems. We will comply with such request unless we have a legitimate ground to not delete the data.
Right to object
You may have the right to object to certain use of your personal data if such data are processed for other purposes than necessary for the performance of the Kasapp Services or for compliance with a legal obligation. If you object to the further processing of your personal data, this may lead to fewer possibilities to use the Kasapp Services.
Right to restriction of processing
You may request us to restrict processing of personal data for example when your data erasure, rectification or objection requests are pending and/or when we do not have legitimate grounds to process your data. This may however lead to fewer possibilities to use the Kasapp Services.
Right to data portability
You have the right to receive the personal data you have provided to us yourself in a structured and commonly used format and to independently transmit those data to a third party.
How to use your rights
The abovementioned rights may be used by sending a letter or an e-mail to us on the addresses set out above, including the following information: the full name, address, e-mail address and a phone number. We may request the provision of additional information necessary to confirm the identity of the User. We may reject or charge requests that are unreasonably repetitive, excessive or manifestly unfounded.
The User has the right to prohibit us from using the User’s personal data for direct marketing purposes, market research and profiling made for direct marketing purposes by contacting us on the addresses indicated above or by using the functionalities of the Kasapp Services or the unsubscribe possibility offered in connection with any direct marketing messages.
In case the User considers our processing of personal data to be inconsistent with the applicable data protection laws, the User may lodge a complaint with the local supervisory authority for data protection in Finland, the Data Protection Ombudsman (https://tietosuoja.fi/etusivu). Alternatively, the User may lodge a complaint with the local supervisory authority for data protection of the User’s country of domicile.
We use administrative, organizational, technical, and physical safeguards to protect the personal data we collect and process. Measures include for example, where appropriate, encryption, pseudonymization, firewalls, secure facilities and access right systems. Our security controls are designed to maintain an appropriate level of data confidentiality, integrity, availability, resilience and ability to restore the data. We regularly test the Kasapp Services, systems, and other assets for security vulnerabilities. Should despite of the security measures, a security breach occur that is likely to have negative effects to the privacy of the Users, we will inform the relevant Users and other affected parties, as well as relevant authorities when required by applicable data protection laws, about the breach as soon as possible.

Kasapp, a company incorporated under the laws of Finland (“Kasapp”) welcomes you to the Kasapp app, that can be accessed, by the end consumers (“Consumers”), through the mobile phone application (“Kasapp Consumer Platform”)
These terms and conditions (“Terms”) shall govern your use of the Kasapp Consumer Platform. Your use of the Kasapp Consumer Platform shall be an indication of your consent to be bound by the Terms in respect of the use of, directly or indirectly, the Kasapp Consumer Platform. Therefore, Kasapp advises you to read the Terms carefully before using the Kasapp Consumer Platform.
Please note that the Terms have been divided into five parts:
a. License to Access
Kasapp grants you a royalty free, non-exclusive, non-transferable, non-sub-licensable, revocable, limited license (“License”) for the use of the Kasapp Consumer Platform so long as the following list of conditions are met at all times:
Failure to comply with the aforementioned conditions shall render your License revoked and will entitle Kasapp to close / delete your account with no recourse available to you either against Kasapp or the Merchants, cancellation of ongoing / existing orders, deletion of the entire history of your activities on the Kasapp Consumer Platform and granting Kasapp the right to pursue a legal action against you in circumstances that Kasapp considers appropriate in its sole discretion.
2. Kasapp shall reserve and retain all rights in regard to the Kasapp Consumer Platform that are not expressly granted to you by these Terms.
b. Your Account
1. In order to use the Kasapp Consumer Platform, you will need to register and set up your account (“Account”) on the Kasapp Consumer Platform. In so doing the above, you undertake to provide correct and up-to-date information about yourself.
2. You will be responsible for keeping your login details and related private information, to the Kasapp Consumer Platform, confidential and thereby not permitting any unauthorized access from your Account. Where you believe or have a reason to believe that the access to your Account is compromised, you will take all actions necessary to either update your login details or delete your account. If you are unable to do the aforementioned, you will intimate Kasapp as soon as possible (“Intimation”). All activities from your Account, unless Kasapp has received an Intimation from you, shall be considered activities undertaken by you.
3. Kasapp reserves the right to suspend, block and / or delete your Account without providing you any reason for doing so where it has a reason to believe that the Account is being used in violation of the Terms.
4. Kasapp shall store, handle and share data as per its Privacy Policy. For the purposes of this Clause, “data” is:
a. Restrictions
1. By entering, registering onto and making use of the Kasapp Consumer Platform, subject to these Terms, you understand and acknowledge that Kasapp Consumer Platform perform an intermediary function between you and the Merchants. The purpose of Kasapp Consumer Platform is to bring competent and willing parties (Consumers and Merchants) onto its platform and facilitate a contract of sale between the two.
2. Kasapp is not responsible nor shall be held responsible for the issues concerning the price quoted of certain Goods / Services by a Merchant, quality of the Goods / Services received, the quantity, fitness for use, specifications, warranties and other ancillary matters. The only recourse available to you in the aforementioned instances shall be against the Merchant(s).
3. Kasapp Consumer Platform, as mentioned above, are only intermediary platforms therefore Kasapp shall not be held responsible for inaccuracies in the product description of the Goods / Services on the Kasapp Consumer Platform and / or if the Goods / Services received by you do not conform to the description provided against the same on the Kasapp Consumer Platform. Kasapp does not examine or inspect the Goods / Services offered by the Merchants on the Kasapp Consumer Platform and disclaims any responsibility or liability in regard to not carrying out such examination or inspection.
4. By entering, registering onto and making use of the Kasapp Consumer Platform, you hereby accept that you have taken a conscious, objective and prudent decision to make use of the Kasapp Consumer Platform and enter into a contract with the Merchants without having any recourse to Kasapp in the case of a dispute of whatsoever nature with the Merchant(s)in respect of the Goods / Services.
5. From the moment the Other Riders have collected the Goods, Kasapp shall be free from any claim arising due to mishaps in the delivery process, the liability, in which case, shall be of such Other Riders or the Merchants, where such Other Riders work for the Merchants. Notwithstanding the above, Kasapp shall be responsible for the gross negligence or willful default of the Kasapp Riders.
6. The listing of Merchants, listing of Goods / Services and provision of website links or other contact details of the Merchants or other businesses on the Kasapp Consumer Platform shall at no time be treated as Kasapp’s endorsement of either the Merchants, the Goods / Services. In the event of your dispute with the aforementioned parties, your legal action shall be subject to the terms and conditions of such parties.

By entering and registering onto the Kasapp Consumer Platform you undertake that you shall not do the following when using the Kasapp Consumer Platform whether directly or indirectly

You acknowledge and understand that Kasapp may, at any time, amend these Terms so as to delete, modify or add new terms and conditions to these Terms (“Amendment”) and you agree to check the Kasapp Consumer Platform regularly if any Amendments have been made and shall not hold Kasapp and / or their directors, officers, employees, affiliates, licensors, licensees, contractors, representatives, partners and agents, Merchants and Riders responsible for damage or losses incurred or inconvenience caused to you as a result of the Amendments

The waiver of any breach or failure to enforce any of the Terms by Kasapp shall not in any way affect, limit or waive Kasapp’s right at any time to enforce strict compliance with every Term hereof.

Should any provision of these Terms be determined to be invalid or unenforceable under any law, rule, or regulation, such determination will not affect the validity or enforceability of any other provision of these Terms.
f. Legal Disputes
These Terms and any non-contractual obligations arising or matters from it or its performance are governed by the law where the app is active and the competent courts at that country shall have exclusive jurisdiction to hear any dispute or controversy arising hereunder
g. Force Majeure
Kasapp shall not be in breach of these Terms nor liable for delay in performing, or failure to perform, any of Kasapp’s obligations under these Terms if such delay or failure result from Force Majeure (acts of God, flood, tempest, epidemics, terrorism, civil commotion, strikes, lock outs and other events outside the control of Kasapp and / or the Merchant
